Introduction

Deed Community Giving Foundation (“Deed Community Giving Foundation,” “DCGF,” “we” or “our”),is operated for the benefit of the nonprofit sector , and is a 501(c)(3) nonprofit organization. Deed Community Giving Foundation operates websites located at www.deedcommunitygivingfoundation.org and www.deedcommunitygivingfoundation.com (the “Sites”), which enable certain users of www.joindeed.com, app.joindeed.org, any organization-specific URL providing access to the Go Deed Inc. services, and other websites or services with which we partner to donate to nonprofit organizations through Deed Community Giving Foundation and our network of partner donor-advised funds (DAFs). This Privacy Policy describes your privacy rights regarding our collection, use, storage, sharing and protection of your personal information, which consists of personally identifiable information associated with an authorized user accessing our Services, including but not limited to name, address, email address, bank account-related details, your organizational affiliation, and/ or other identifiers or identifying information (“Personal Information”). This policy applies to the Deed Community Giving Foundation website, our Services, and all related sites, applications, services and tools, regardless of how you access or use them.

Scope and consent

You accept this Privacy Policy (“Privacy Policy”) when you sign up for, access, or use our products, services, content, features, technologies or functions offered on our website and all related sites, applications, services, and tools (including if you access or utilize our services and websites via www.joindeed.com, app.joindeed.org, and any organization-specific URL or partner site providing access to the Deed Community Giving Foundation services; collectively “Deed Community Giving Foundation Services” or “Services”). We may amend this Privacy Policy at any time by posting a revised version on our website. The revised version will be effective at the time we post it and in no event later than 7 days from the date of posting. Your continued use of the Deed Community Giving Foundation Services following posting of amendments will be considered express consent to all amendments to this Privacy Policy.

In order to make donations, donors must agree to this Privacy Policy, the Deed Community Giving Foundation Donor Terms of Service, and as may be applicable, relevant, or appropriate to certain donations and activities, the terms and conditions of www.joindeed.com, Deed Community Giving Foundation’s partner DAFs, or other third party website or services used to facilitate Deed Community Giving Foundation Services (collectively, the “Terms and Conditions”). Persons and organizations (including persons acting as representatives of Organizations) with permission to use our Services (including, as may be applicable, this Site) are considered “Authorized Users.” You may view portions of the Site even if you are not an Authorized User. This Privacy Policy applies to Deed Community Giving Foundation’s collection, use and disclosure of Personal Information from Authorized Users, as well as from persons who merely visit the Site, and this Privacy Policy is expressly incorporated in the Terms and Conditions. Deed Community Giving Foundation has adopted and implemented this Privacy Policy as part of our commitment to protecting your personal information.

What information do we collect?

Deed Community Giving Foundation may collect the following types of personal information in order to provide you with the use of and access to the Deed Community Giving Foundation Services, and to personalize and improve your experience. Deed Community Giving Foundation collects information both automatically and from you when you access our Site and any of the Deed Community Giving Foundation Services.

Information collected automatically: Deed Community Giving Foundation may collect information from your computer, mobile phone, or other access device. This information may include, but is not limited to, data about the pages you access, computer IP address, device ID or unique identifier, device type, geo-location information, computer and connection information, mobile network information, statistics on page views, traffic to and from the sites, referral URL, ad data, and standard web log data and other information. We may also collect additional information through the Deed Community Giving Foundation Services that cannot be used to personally identify you (all such information is “Non-Personal Data”). Non-Personal Data ordinarily includes aggregate, summary, de-identified or other anonymous data, and may include, by way of example, statistics regarding total website visitors, total registrations, total amount of donations, popularity of particular pages within the Site, or information regarding types of Internet browsers used by Authorized Users. We also collect anonymous information through our use of cookies.

“Cookies” are small files placed on a user’s computer by a website in order to facilitate use of that website. For example, a cookie may contain information about a user’s preferences, so that the website automatically complies with those preferences whenever the user visits that website. When using the Site and Services, we may create “cookies” on your computer for the purposes of facilitating and maintaining your current user session, and may collect Personal Information using those cookies in order to enable Deed Community Giving Foundation and partners to identify you in connection with the Site and to track use of the Site and Services for purposes consistent with this policy. You are free to decline our Cookies if your browser or browser add-on permits, unless our Cookies are required to help prevent fraud or help ensure the security of websites we control. However, declining our Cookies may interfere with your use of the Site and Deed Community Giving Foundation Services.

Do Not Track: Do Not Track (DNT) is an optional browser setting that allows you to express your preferences regarding tracking by advertisers and other third-parties.

Information you provide to us: We may collect and store any information you provide to us (including when you authorize third parties and entities affiliated with the Deed Community Giving Foundation such as Go Deed Inc. to share information with us) when you access and use the Deed Community Giving Foundation Services, including but not limited to during direct communications, any related account creation process, when processing donation payments, or as otherwise required to access or use the Deed Community Giving Foundation Services. In addition, Deed Community Giving Foundation collects certain Non-Personal Data.

Information from other sources: Deed Community Giving Foundation may also receive information about you from other sources with your permission, including Go Deed Inc.. This information may include, but is not limited to, Authorized Users’ Go Deed Inc. account details and information, including Go Deed Inc. site activity details, names, account IDs, email address and donation-related data. This data may be used to collect and maintain records of all transactions conducted through the Deed Community Giving Foundation Services. Those records may be associated with each Authorized User’s account for or with Deed Community Giving Foundation. Please note that Authorized User’s Go Deed Inc. credentials and passwords will never be shared with Deed Community Giving Foundation.

Deed Community Giving Foundation may collect and maintain a record of all data provided through any of the above-mentioned channels. In the course of making or receiving donations, Authorized Users may be required to provide certain contact information and financial information, such as individual name and position, company name, address, email address, wire/ ACH/ routing information, and/or bank account details or identifiers.

We also collect and maintain records of information that you voluntarily provide to us. For example, we may ask you to participate in a survey of Authorized Users, and may ask you to provide personally identifiable information. However, unless such information is necessary for operating the Site and/or Services or required by the Terms and Conditions, we do not require you to provide such information to us. By providing such information voluntarily, you give Deed Community Giving Foundation permission to use such information as described in this Privacy Policy.

The Deed Community Giving Foundation Services are not directed to children and children are not eligible to use the Deed Community Giving Foundation Services. Protecting the privacy of children is very important to us. We do not collect or maintain personal information from people we actually know are under 18, and no part of the Deed Community Giving Foundation Services are designed to attract people under 18. If we later learn that a user is under 18, we will take steps to remove that user’s Personal Information from our databases and to prevent the user from utilizing the Deed Community Giving Foundation Services.

Use and disclosure of collected information

Deed Community Giving Foundation uses information collected from the Deed Community Giving Foundation Services in several ways, as outlined in this Privacy Policy.

For example, we use Personal Information as needed to process donations made or authorized by Authorized Users, and to communicate with such Authorized Users. We also use both Personal Information and Non-Personal Data when evaluating ways to improve the Deed Community Giving Foundation Services. As further described below, we may disclose collected information, including Personal Information, to certain third parties in connection with collecting or processing donations, as well as associated record-keeping practices, or as required by law.

We will not use or disclose collected information in ways different from what is described in this Privacy Policy unless otherwise required by law.

Deed Community Giving Foundation uses information that we collect from you in order to provide donation services as described in the Deed Community Giving Foundation Donor Terms of Service or as required by law (“Necessary Disclosures”). For example, we use such information to do the following:

To communicate with each Authorized User to confirm registration, transactions, and other activities, and to inform an Authorized Userabout the status of particular charitable listings or donation activity, or to share other information as otherwise necessary to provide the Deed Community Giving Foundation Services;

To process donations, including, but not limited to, invoicing donors, obtaining authorizations for payment, confirming payments, sharing information with partner DAFs and Go Deed Inc. to facilitate and record donation transactions, and as may be applicable, sharing information related to non-anonymous donations with recipient charities;

To send Authorized Users receipts and appropriate tax documentation for donations made through the Site; and

As authorized, with Go Deed Inc., in order to display information about donation transactions in an Authorized User’s Go Deed Inc. profile.

As a necessary part of providing the Deed Community Giving Foundation Services and processing donations, we may disclose information collected from you as described in this Privacy Policy. For example, we will disclose certain Personal Information collected from you through the Deed Community Giving Foundation Services to Go Deed Inc., our partner DAFs, other websites and services with which we partner, and to our registered nonprofit organizations. We may also provide Personal Information about you to our third party service providers for the purpose of receiving and processing payments. These third parties are prohibited from using your personal information for any other purpose than what is disclosed in this Privacy Policy and the Terms and Conditions. When you use the Deed Community Giving Foundation Services to choose a charity to be the intended beneficiary of a donation, we may also disclose your name and contact information to the nonprofit organization that you have designated. Under certain limited circumstances, we may be subject to legal requirements to disclose information collected through the Deed Community Giving Foundation Services, and our policy is to comply fully with all such legal requirements. The disclosures contemplated by this paragraph are necessary if you wish to use the Deed Community Giving Foundation Services. As mentioned below, Deed Community Giving Foundation may use and disclose Non-Personal Data without restriction. If you do not want us to make such Necessary Disclosures, or to use Non-Personal Data without restriction, you must not use the Services.

Deed Community Giving Foundation may also use information collected through the Deed Community Giving Foundation Services to communicate with the Authorized Users from whom such information was collected in order to provide promotional materials about Deed Community Giving Foundation, about nonprofit organizations participating in the Services, and/or about our partners and affiliates. “Optional Communications” are all communications to Authorized Users that are optional, including but not limited to promotional materials about Deed Community Giving Foundation, about nonprofit organizations participating in the Service, and/or about our partners and affiliates. Deed Community Giving Foundation will refrain from sending Optional Communications to you if you inform us that you prefer not to receive them.

If we collect information that you provide to us voluntarily by participating in online surveys, through email communications, or by other means, we will treat that information as described above, as applied to both Personal Information and Non-Personal Data.

Deed Community Giving Foundation uses Non-Personal Data in a variety of ways, including but not limited to, evaluating the performance of the Site and the general preferences of Authorized Users, or to generate anonymous statistics for the benefit of nonprofit organizations participating in the Services or for our partners. Because Non-Personal Data is entirely anonymous, and therefore can never be used by us to identify you, this Privacy Policy does not limit Deed Community Giving Foundation’s ability to use or disclose Non-Personal Data.

Deed Community Giving Foundation will respect your preferences regarding whether it is permissible for us to make disclosures of Personal Information, as you may indicate to us in written communications.. Deed Community Giving Foundation will not make Optional Disclosures of your Personal Information if you inform us of that preference as described herein.

We will not sell, trade or rent your personal information to any third party for promotional or unknown uses.

Choice, and opting-in to Optional Communications and Optional Disclosures

Because Deed Community Giving Foundation respects your privacy, we provide certain opportunities for you to indicate your preferences regarding how we use and/or disclose information collected about you from the Deed Community Giving Foundation Services.

If you are an Authorized User, you will be able to inform us whether you wish to receive certain Optional Communications from us and our select partners by indicating your preferences in writing. Each Authorized User may also indicate such preferences during the initial registration process, or may contact us at dcgf@joindeed.com.

Please also note that, although we will respect preferences that you indicate regarding Optional Communications and Optional Disclosures, information is nevertheless collected from your use of the Deed Community Giving Foundation Services as described above, and certain transaction-related communications will be sent regardless of your preferences. We will treat Personal Information collected from you in accordance with your preferences, unless otherwise required by applicable law.

Deed Community Giving Foundation does not maintain responsibility for the manner in which third parties use or further disclose Personal Information collected from you through the Site after Deed Community Giving Foundation has disclosed that information to those third parties. However, we do require our third-party service providers to promise not to use such information except as necessary to provide the relevant services to us. If you do not want Deed Community Giving Foundation to use or disclose Personal Information collected about you in the manners identified in this Privacy Policy as “Necessary Communications” and/or Necessary Disclosures, you must not use the Deed Community Giving Foundation Services. Necessary Communications are any and all communications that are necessary to provide the Services to Authorized Users. If you are merely a visitor to the Site but are not registered as an Authorized User, please note that Deed Community Giving Foundation does not collect any Personal Information except for information collected automatically in connection with the Site, so you do not need to opt-out regarding any such communications or disclosures.

The Site contains links to other websites. Please be aware that Deed Community Giving Foundation is not responsible for the privacy practices or the content of such other websites. Deed Community Giving Foundation encourages our users to be aware when they leave our Site and to read the privacy statements of each and every website that collects personally identifiable information. This Privacy Policy applies solely to information collected by Deed Community Giving Foundation through our Services, the Site and through all related sites, applications, services and tools.

Access to personal information collected from you

Authorized Users may request that any of their Personal Information involved in the Services be updated or removed at any time. Subsequent uses or disclosures of information by Deed Community Giving Foundation will reflect those changes, but Deed Community Giving Foundation has no ability to update any information previously disclosed to any third party. Certain information associated your account may be provided to Deed Community Giving Foundation by Go Deed Inc. with your permission (such as name, address and email address), and in such cases you will only be able to update such information by doing so within your Go Deed Inc. account, after which the updates will be reflected by Deed Community Giving Foundation. Certain information, including email address, is necessary in order for Deed Community Giving Foundation to provide the Deed Community Giving Foundation Services; therefore, if you delete such necessary information you may not be able to use the Services.

Notwithstanding the foregoing, certain information may only be changed by contacting Deed Community Giving Foundation directly (at dcgf@joindeed.com), or by following the instructions that Deed Community Giving Foundation may provide.

How we protect and store personal Information

Throughout this Privacy Policy, we refer to “personal information” to describe information that can be associated with a specific person and can be used to identify that person. We do not consider personal information to include Non-Personal Data. We store and process your personal information on our computers in the United States and elsewhere in the world where our facilities are located. We protect your information using physical, technical, and administrative security measures to reduce the risks of loss, misuse, unauthorized access, disclosure and alteration. Some of the safeguards we use are firewalls and data encryption, physical access controls to our data centers, and information access authorization controls.

Please be aware that, although we endeavor to provide reasonable security for information in our possession and control, no security system can prevent against all potential security breaches, and Deed Community Giving Foundation bears no liability for uses or disclosures of Personal Information or Non-Personal Data arising in connection with the theft thereof.

Likewise, Authorized Users are responsible for safeguarding the confidentiality of the accounts used to provide sensitive information by them to Deed Community Giving Foundation, and Deed Community Giving Foundation bears no liability for access to, or use or disclosure of, Personal Information, if such access, use or disclosure arises in connection with the theft or unauthorized control (whether intentional or negligent) of such Authorized User’s existing accounts (such as email accounts of phone numbers).
